Doctrine of Equivalents: Requirement 3

There are five requirements for the doctrine of equivalents.

According to the Supreme Court, the Requirement 3 is that “the replacement of the part would have been obvious to a skilled person in the art at the time of producing the product (the time of the infringement).” (H6 (O) 1083)
